Forensic & Legal Consulting
When square footage is the dispute, the measurement has to hold up.
Solid Tech provides consulting and testifying expert services for rentable area, lease, and architectural disputes. Our work is led by the Chair of BOMA International's Floor Measurement Standards Interpretations Committee and a licensed Colorado architect.
Expertise from inside the standards
Most measurement disputes turn on interpretation: which standard applies, which version, and how a specific condition should be classified. We work on those questions every day, and we help write the guidance the industry relies on.
Our principal, Garett Naff, AIA, brings:
Chair, BOMA International FMS Interpretations Committee, with 14 years of committee service. The committee approves and issues BOMA's Floor Area Measurement Best Practices.
Contributor to 8 of BOMA's 26 Best Practices published since 2014.
Credited contributor to the current BOMA standards, including Office, Gross Areas (GRAMS), Industrial, Retail, Mixed Use, and Multi-Family & Hospitality.
Licensed Colorado architect since 2007, with 30 years in architecture and commercial real estate.
Courtroom experience. Trial testimony and litigation support for both landlords and tenants, in California, Colorado, and Washington.
That combination matters in a dispute. An expert who helped shape the standard can explain not only what it says, but why it says it, in terms a judge, jury, or arbitrator can follow.
Where area drives the dollars
Rent, CAM, and pro-rata share disputes. We test whether rentable and usable areas were measured correctly, whether the stated standard was applied consistently, and how errors flow through base rent, operating expenses, and tenant shares.
Lease remeasurement challenges. When a landlord remeasures a building and a tenant's area grows, or a tenant questions a long-standing figure, we provide an independent measurement and a clear explanation of the differences.
Co-tenancy and occupancy disputes. Co-tenancy clauses often depend on how much of a center is open and operating. We verify the actual area of each space so the occupancy calculation rests on facts rather than assumptions, including where the lease does not reference BOMA.
Transaction and valuation disputes. Purchase price adjustments, appraisal conflicts, and lender due diligence questions frequently trace back to an area figure. We establish what the building actually contains.
Eminent domain and insurance claims. Partial takings and property losses can turn on precise area. We document existing conditions and quantify what was affected.
Architectural standard of care. As licensed architects, we review design documents, drawings, and expert reports to assess whether a design team met its professional obligations, including waterproofing, drainage, and code compliance issues.
Early answers, defensible opinions.
Consulting expert. Many matters never reach a courtroom. We work confidentially with counsel to assess the strength of a measurement position, identify weaknesses before the other side does, and support settlement discussions.
Testifying expert. We prepare written expert reports, sit for deposition, and testify at trial or in arbitration. Our opinions are grounded in field measurement and the published standards, and explained in plain language.
Rebuttal review. When the opposing party has already produced a measurement or expert report, we review it for errors in method, standard selection, and classification. A rebuttal review is often an efficient first step.
Independent measurement neutral. Some leases call for a third party to resolve remeasurement disagreements. We serve as that neutral third party, and we help landlords, tenants, and brokers draft remeasurement clauses that reduce the chance of a dispute in the first place.
Scan-based evidence capture. Using 3D laser scanning, we document existing conditions in detail before a space is altered, demised, or demolished. The resulting point cloud preserves the record and produces clear visual exhibits for a judge, jury, or arbitrator.
Attorney education. We offer short sessions for law firms on how rentable area is calculated, where errors typically occur, and what questions to ask early in a case.
